| Outcomes: Students are able to (1) demonstrate a broad understanding of theoretical approaches to interpreting Australian legal history and historiography; (2) demonstrate specific understanding of the particular debates in Australian legal history that have been the particular focus of the unit as indicated in the unit outline; (3) communicate effectively using concepts and ideas from the interdisciplinary field of legal history; (4) express legal–historical arguments coherently, sceptically and logically; (5) read legal history source materials critically, as historical evidence; (6) appreciate the breadth of legal history and of the potential sources for legal historical study; (7) apply legal historical interpretive concepts to critically and sceptically interpreting source materials; (8) demonstrate an appreciation of the historical, cultural and ideological contingency of law; and (9) demonstrate a detailed understanding of the specific legal historical subject matter that has been the subject of the student's personal research projects. |

| Content: This unit covers introductions to history, historiography and Australian legal history, followed by more detailed critical study of specific topics including the process of Federation; conscription; the powers of the High Commonwealth during war; the attempted banning of the Communist Party; the attempted secession of WA; the law of The Dismissal; war crimes and terrorism; native title; the use of history in constitutional interpretation and within the law of evidence; and legal biography with emphasis on particular judges. The unit deals with the constant and complex interplay of source and (legal) historian; and the dialogues between law and history, past and present. |

Assessment: Students are required to attend and participate in seminars, write a short written assignment, a long research assignment and complete a take-home examination.
Supplementary assessment is not available in this unit except in the case of a bachelor's pass degree student who has obtained a mark of 45 to 49 and is currently enrolled in this unit, and it is the only remaining unit that the student must pass in order to complete their course. |
