ContentThis unit is a study of the various matters which are likely to arise in action based on s.52 of the Commonwealth of Australia Trade Practices Act 1974 and the corresponding provisions of the Fair Trading Act of the various states. Matters which are analysed include the judicial construction of the phrase 'misleading and deceptive conduct'; parties to a misleading and deceptive conduct claim; causation and remoteness in actions based on the breach of s.52; damages and other remedies and the limitation period.
 
AssessmentStudents must undertake an end-of-semester examination and have the option of completing an assignment.

Supplementary assessment is not available in this unit except in the case of a bachelor's pass degree student who has obtained a mark of 45 to 49 and is currently enrolled in this unit, and it is the only remaining unit that the student must pass in order to complete their course.
