OutcomesStudents are able to (1) gain a good understanding of the law of succession; (2) have a good understanding of the Wills Act 1970 (WA) and the Wills Amendment Act 2006; (3) explain the changes and reasons for the changes made or to be made in the Wills Amendment Act 2006; (4) gain knowledge of testate and intestate succession; (5) have knowledge of the elements of a claim against an estate for further provision by an eligible person for some or further provision from an estate; and (6) have knowledge of the Inheritance (Family and Dependants Provision) Act 1972 and possible changes to be made to that Act in the near future.
 
ContentThis unit is concerned with the law relating to wills, estates, intestacy and family provision. Topics include the definition and nature of a will, formal requirements of a will, construction of wills, vitiating factors affecting testators, vitiating factors affecting beneficiaries, revocation, republication and revival of wills, legacies and devises, intestate succession, administration of estates of deceased persons and family provision after death.
 
AssessmentStudents are required to complete an assignment (30 per cent) and a final examination (70 per cent).

Supplementary assessment is not available in this unit except in the case of a bachelor's pass degree student who has obtained a mark of 45 to 49 and is currently enrolled in this unit, and it is the only remaining unit that the student must pass in order to complete their course.
