LAWS3336 Negotiation and Mediation

OutcomesStudents are able to (1) understand at a basic level the theory, process and practice of positional and principled negotiation; (2) understand at a basic level the theory, process and practice of mediation; (3) improve communication skills; (4) develop the ability to prepare for and represent clients in negotiation and mediation; and (5) develop the process and communication skills used in mediation.
 
ContentAdmission to this unit, taught as a one-week intensive course, is restricted by a quota of 36. Students wishing to enrol in this unit should note the information on enrolling in quota units in the Faculty of Law, available at http://www.studentadmin.uwa.edu.au/page/8995. Priority is given to students in their final year or final semester of study.

The unit examines the theory, process and practice of negotiation and mediation. It develops and improves the student's skill and ability to prepare for and represent clients in negotiation and mediation and to participate as a mediator.

The unit is taught intensively over five days through a series of negotiation and mediation seminars, role plays and other exercises. The class activities move from the use of the fundamental skills of effective negotiation to exercises involving disputes of increasing complexity for negotiation and mediation.
 
AssessmentThis is a pass/fail unit. A pass or fail grade is awarded based on participation in the class and discussions, submission of written work during the week, journal entries and an evaluation of demonstrated skills in mediation and negotiation exercises.

Supplementary assessment is not available in this unit because the Faculty has been granted an exemption.

NoteIf students are planning to study both LAWS3336 Negotiation and Mediation and LAWS3365 Alternative Dispute Resolution, it is strongly recommended that students study LAWS3365 Alternative Dispute Resolution first.
