LAWS3351 Advanced Constitutional Law

OutcomesStudents develop the capacity to examine and analyse Australian constitutional law issues at an advanced level, against a background of aspects of the contemporary practice of public law litigation.
 
ContentThis unit explores, at a deeper conceptual level than the basic constitutional law units, a variety of current problems, High Court decisions and approaches to constitutional interpretation. Attention is given to contemporary topics in government and social policy which present particular challenges to the constitutional lawyer and to federal and state governments. The unit draws on comparisons with the United States and the United Kingdom regarding constitutional doctrine, thought and judicial method.

As one of the aims is to prepare graduates for professional practice in public law, some practical aspects of litigation are incorporated into the unit.
 
AssessmentThis unit is taught in a seminar-style format combining orthodox lecturing with class discussion. Students are awarded a mark for class participation and may complete an optional mid-semester essay. The marks for those two assessments are redeemable. A take-home examination, comprising written work on doctrinal, analytical, and practical components of the unit, constitutes the major component of the unit's assessment.

Supplementary assessment is not available in this unit except in the case of a bachelor's pass degree student who has obtained a mark of 45 to 49 and is currently enrolled in this unit, and it is the only remaining unit that the student must pass in order to complete their course.

Statutes and Materials

There is no set text for the unit, although books and materials used in LAWS4400 Constitutional Law I and LAWS4401 Constitutional Law II are frequently useful. Relevant materials—set out in a detailed Course Outline—are available in Course Materials Online or they can be downloaded from Internet-based sources or provided in hard copy form.

Books and other material wherever listed may be subject to change. Book lists relating to 'Preliminary Reading', 'Recommended Reading' and 'Textbooks' are, in most cases, available at the University Co-operative Bookshop (from early January) and appropriate administrative offices for students to consult. For first-year units the Bookshop will endeavour to make available photocopies of book lists for individual units. Books marked with an asterisk (*) are available in paperback.
