Outcomes: Students are able to, through their knowledge of the Insurance Contracts Act 1984, (1) identify the relevant legal issues; (2) analyse the law in a relevant, logical and methodical manner; (3) apply the relevant law to the facts; and (4) persuade, by their reasoning process, why their conclusion in relation to a problem is the right one and why any insistent alternatives are not correct for the circumstances.

Content: The Commonwealth of Australia Insurance Contracts Act 1984 made radical changes to Australian insurance law. In this unit, this Act is studied together with the common law and equitable concepts, insofar as they either assist with an understanding of the Act or are unaffected by it.

Assessment: This comprises a written essay (20 per cent), a group assignment and presentation (20 per cent) and a final open-book examination (60 per cent).
Supplementary assessment is not available in this unit except in the case of a bachelor's pass degree student who has obtained a mark of 45 to 49 and is currently enrolled in this unit, and it is the only remaining unit that the student must pass in order to complete their course. |
